{"id":139,"date":"2011-03-28T14:10:21","date_gmt":"2011-03-28T18:10:21","guid":{"rendered":"http:\/\/www.themanwholostchina.com\/?p=139"},"modified":"2011-03-28T14:10:21","modified_gmt":"2011-03-28T18:10:21","slug":"when-judges-kill-cases-looking-back-at-lattimore","status":"publish","type":"post","link":"http:\/\/www.themanwholostchina.com\/?p=139","title":{"rendered":"When Judges Kill [Cases] &#8211; Looking Back At Lattimore"},"content":{"rendered":"<p><strong>The Court In Unhappier Days <img loading=\"lazy\" decoding=\"async\" class=\"alignnone size-full wp-image-140\" title=\"lattimorepleadsnotguilty\" src=\"http:\/\/www.themanwholostchina.com\/wp-content\/uploads\/2011\/03\/lattimorepleadsnotguilty.jpeg\" alt=\"\" width=\"300\" height=\"226\" \/><\/strong><\/p>\n<p>Washington&#8217;s Federal Courthouse was the scene of some of the final acts in the Lattimore drama, where twice the presiding judge in the case <a href=\"http:\/\/www.answers.com\/topic\/united-states-v-lattimore\">threw ou<\/a>t the government&#8217;s principal charges, <a href=\"http:\/\/law.justia.com\/cases\/federal\/appellate-courts\/F2\/215\/847\/55170\/\">gutting the case<\/a>.<\/p>\n<p>On May 12th the court will <a href=\"http:\/\/legalhistoryblog.blogspot.com\/2011\/03\/dc-circuit-in-mccarthy-era-united.html\">revisit Lattimore<\/a>, with the <a href=\"http:\/\/www.dcchs.org\/news\/USvsLattimore_flyer.pdf\">Historical Society of the District of Columbia Circuit and the Litigation Section of the District of Columbia Bar<\/a> staging a re-enactment of parts of the case, and an overview of its significance. \u00c2\u00a0Several participants played small rolls in Lattimore back in the day:<\/p>\n<p>Patricia M. Wald, former Chief Judge, U.S. Court of Appeals for the D.C. Circuit who was with Lattimore&#8217;s Arnold, Fortas &amp; \u00c2\u00a0Porter defense team,<\/p>\n<p>G. Duane (Bud) Vieth, still with Arnold &amp; Porter, the firm&#8217;s successor,<\/p>\n<p>Berl Bernhard, former clerk for Judge Luther Youngdahl, who sank the government&#8217;s case.<\/p>\n<p><strong> <img loading=\"lazy\" decoding=\"async\" class=\"alignnone size-full wp-image-142\" title=\"lattimorebeats4liecharges\" src=\"http:\/\/www.themanwholostchina.com\/wp-content\/uploads\/2011\/03\/lattimorebeats4liecharges-e1301335631109.jpg\" alt=\"\" width=\"200\" height=\"78\" \/> <img loading=\"lazy\" decoding=\"async\" class=\"alignnone size-full wp-image-143\" title=\"youngdahlshirt\" src=\"http:\/\/www.themanwholostchina.com\/wp-content\/uploads\/2011\/03\/youngdahlshirt.jpeg\" alt=\"\" width=\"233\" height=\"196\" \/><\/strong><\/p>\n<p>Also participating will be <a href=\"http:\/\/washingtonindependent.com\/44559\/remember-miguel-estrada\">conservative legal legend<\/a> Miguel Estrada, whose DC Appeals Court nomination by George W.
